1. Introduction

These terms and conditions (the "Terms") govern your use of the Beer Fest Buddy website (www.beerfestbuddy.com) and all related services, applications, features and content (collectively, the "Service") operated by Beer Fest Buddy Ltd ("we," "our," "us," or "Beer Fest Buddy").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, you must not access or use the Service.

2. Eligibility

To use the Service, you must be at least 18 years old. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you may need to register for an account. When registering, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3.3 Festival and Brewery Profiles

If you create a profile for a festival or brewery, you represent and warrant that you have the authority to do so on behalf of that organisation. You are responsible for ensuring all information provided is accurate, legal, and does not infringe on third-party rights.

4. User Content

4.1 Ownership

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, create derivative works from, distribute, publicly display, and publicly perform your User Content for the purpose of operating, developing, and improving the Service.

4.2 Prohibited Content

You agree not to submit User Content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringes on the intellectual property rights or other rights of any third party
  • Contains software viruses or any other code designed to harm or interfere with the Service
  • Includes any excessive promotion of alcohol consumption or encourages irresponsible drinking
  • Includes information about someone else without their consent

4.3 Content Moderation

We reserve the right, but not the obligation, to monitor and review User Content. We may remove or refuse to display content that we believe violates these Terms or may harm our users, third parties, or us.

5. Service Usage

5.1 General Usage Rules

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable law or regulation
  • Impersonate any person or entity or misrepresent your affiliation with a person or entity
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to transmit any advertising or promotional material without our prior written consent
  • Interfere with or disrupt the Service or servers or networks connected to the Service

5.2 Future Services

Additional services, such as ticketing and payment processing, may be added to the Service in the future. When such services become available, additional terms specific to those services will be provided.

5.3 Directory Listings

Directory listings for festivals and breweries may be subject to review and approval. We reserve the right to remove or refuse listings that do not comply with our standards or these Terms.

Information in directory listings may be provided by third parties or collected from publicly available sources. While we make reasonable efforts to ensure the accuracy and reliability of listing information, we cannot guarantee its completeness or accuracy. Users should independently verify event details, including dates, times, locations, and ticket availability directly with event organisers before making any plans to attend. Beer Fest Buddy is not responsible for any inconvenience, loss, or damage resulting from inaccurate or incomplete listing information.

6. Intellectual Property

6.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by Beer Fest Buddy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2 License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

6.3 Feedback

If you provide us with any feedback or suggestions regarding the Service, you grant us the right to use such feedback without restriction and without any compensation to you.

7. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by Beer Fest Buddy. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Beer Fest Buddy shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services available through third parties.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BEER FEST BUDDY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO US DURING THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR £100, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless Beer Fest Buddy and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of and access to the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right
  • Any claim that your User Content caused damage to a third party

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature if available.

11.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in England and Wales for the resolution of any disputes arising out of or relating to these Terms or the Service.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Beer Fest Buddy regarding the Service and supersede and replace any prior agreements we might have had between us regarding the Service.

16. Age Restrictions and Alcohol Content

As our Service relates to beer festivals and events where alcohol may be served, we would like to remind users that:

  • You must be at least 18 years old to use our Service
  • We do not encourage excessive or irresponsible alcohol consumption
  • All users are responsible for complying with local laws regarding alcohol consumption and purchase
  • Content on our Service is not intended to appeal to minors

Beer Fest Buddy does not sell alcohol directly. We provide information about festivals, breweries, and events where alcohol may be available. We encourage responsible drinking and compliance with all applicable laws and regulations regarding alcohol consumption.

17. Force Majeure

Neither Beer Fest Buddy nor you shall be liable for failure to perform any obligation under these Terms if such failure is caused by the occurrence of any contingency beyond the reasonable control of either party, including without limitation acts of God, war, terrorism, riots, fire, flood, internet or telecommunications failure, or other disaster.

18. Data Protection

Our processing of personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to such processing and you warrant that all data provided by you is accurate.

In relation to any personal data that you may provide about third parties (such as contacts for festival organisers or brewery representatives), you warrant that you have obtained all necessary consents to share this information with us and that such sharing complies with applicable data protection laws.

19. Assignment

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you but may be assigned by Beer Fest Buddy without restriction.
